How can I shorten a lease agreement?

For different reasons, landlords may want to shorten the lease agreement they have signed with a tenant. This step-by-step guide will help you, as a landlord, understand how to shorten the lease agreement.  

Termination by mutual agreement

  • Go to your profile
  • Click on “Tenants” in the menu and choose the specific tenant. 
  • Click on “Agreements” to see the details of your current lease agreement(s) you have signed and choose the lease agreement you want to shorten.
  • Click on “Terminate agreement”. 

  • Select the termination type (In this case, it’s termination by mutual agreement.) 
  • Choose the new move-out date.
  • Save the changes.

Important notes

  • Only the landlord can create a termination document for the “by mutual agreement” type of termination.
  • After you save the changes, the termination document will be automatically created in our system in the form of an amendment and will appear in the tenant’s profile. Then it’s up to the tenant to sign the termination document. It’ll become valid only if the tenant signs it. 
  • After the termination document is created, the rents are automatically re-calculated.
    • If there is an overpayment because of this, the landlord is obligated to refund the proportional part to the tenant, including the commission fee (paid to Flatio). After they have done this and Flatio has received confirmation of the refund, we will pay the commission back to the landlord. (This procedure is designed and should be completed this way for accounting reasons.)
    • If the tenant still hasn't paid any due payment, the rents will also be re-calculated. For example, if the tenant should have paid 1000 € for the next month but the lease agreement was shortened, the due payment will be changed according to the number of days the tenant will actually stay in the accommodation. 
    • Overall, the tenant pays only for the days when the landlord’s calendar is blocked in terms of availability due to the lease agreement. (That’s until the move-out date, including the move-out day itself.) 

 

Termination by the tenant

  • Go to your profile
  • Click on “Tenants” in the menu and choose the specific tenant. 
  • Click on “Agreements” to see the details of your current lease agreement(s) you have signed and choose the lease agreement you want to shorten.
  • Click on “Terminate agreement”. 

  • Select the termination type (In this case, it’s termination by the tenant.) 
  • Fill in the date when you received a termination notice from the tenant. (Flatio will then automatically calculate and enter the new move-out date, which is 30 days after the notice, unless you fill in the “The lease agreement will be terminated by” field yourself. In this case, we’ll use the date you entered).

Important notes

  • Either the tenant or the landlord can create a termination document for the “by the tenant” type of termination. If the tenant doesn’t do this, the landlord can go to their own profile and create the termination document on behalf of the tenant. 
  • The 30-day notice period means the tenant is obligated to pay for that entire period. They may have already paid the rent for a number of days in advance, but they must also pay the rest of the rent due so that all 30 days are paid for.

 

Termination by the landlord

  • Click on “Agreements” to see the details of your current lease agreement(s) you have signed and choose the lease agreement you want to shorten.
  • Click on “Terminate agreement”. 

  • Select the termination type (In this case, it’s termination by the landlord.) 
  • Choose the new move-out date.
  • Save the changes.

Important note

  • Only the landlord can create a termination document for the “by the landlord” type of termination.

 

Termination for gross violation

  • Go to your profile
  • Click on “Tenants” in the menu and choose the specific tenant. 
  • Click on “Agreements” to see the details of your current lease agreement(s) you have signed and choose the lease agreement you want to shorten.
  • Click on “Terminate agreement”. 

  • Select the termination type (In this case, it’s termination for gross violation.) 
  • Choose the date when you want the lease agreement to be terminated
  • Explain the reason why you want to create a termination document “for gross violation”. 
  • Save the changes.

Important notes

  • Only the landlord can create a termination document for the “gross violation” type of termination.
  • This kind of termination document can be created through the procedure described above only if the tenant is 7 days or more late with the rent payment. 
  • This kind of termination takes place with a 3-day notice. (This means the lease agreement will be terminated 3 days after you create the termination document.) 
  • If you want to terminate the agreement “for gross violation” for reasons other than the tenant being 7 days or more late with the rent payment (for example, if the tenant violates the rules stated in the listing by smoking, partying, bringing pets, disturbing the neighbors with loud music, etc.), you should contact our Customer Care team
  • After we receive your request, we'll call the tenant to inquire about the situation and, if necessary, ask you to provide evidence of the gross violation of the lease agreement.
  • If the reasons given are considered valid by Flatio, we’ll create the termination document for the landlord. In this case, the notice period can be shorter than 3 days (for example, it can be only 2 hours). However, it always depends on the specific situation.
